What is an environmental permit, and do I need one?

An environmental permit represents legal permission to carry out an activity that risks polluting or harming the environment (land, water, or air). They’re required under the Environmental Permitting (England and Wales) Regulations 2016 and will specify conditions to control or prevent environmental harm, which must be met. Different activities require different types of permit (issued by different bodies) and a single type can also be standard or bespoke. Determining whether you need a permit, and which type, can be complex. However, operating without one when required is against the law. What is a permit variation?

Your environmental permit must accurately reflect your operations. As your business evolves, you may need to expand or add new activities to your permit, change the wastes you handle, your company details, or transfer your environmental permit to another entity. Flood risk activities

Activities on or near main rivers, floodplains, flood or sea defences – such as development, construction, industry, or land management – often require Flood Risk Activity Permits to minimise flood risk and the effects of flooding on communities and the environment.

Medium combustion plants

Medium-sized combustion facilities (1-50 MW thermal input) are regulated under the Medium Combustion Plant Directive (EU) 2015, requiring a Medium Combustion Plant Permit to operate. This controls emissions of harmful air pollutants such as sulphur dioxide and dust.

Trade effluent discharge

Businesses discharging liquid waste (effluent) from their premises must obtain a discharge consent. Unregulated trade effluent can cause severe damage to sewage systems, the environment, and people’s health and safety.
